At the November meeting of the Regents, Regent Tilles brought to the commmission the concerns from around the state that the language in the regulation is mandatory and they keep saying it's optional. The board of regents extended the emergency regulation with absolutely NO changes and said they would consider language changes upon full adoption in January. Because of their complete inaction and continued lies on the nature of this regulation, as clearly stated in the reg. 16 Long Island districts, and counting, multiple municipalities and thousands of residents have commenced an Article 78 proceeding against the State Ed department. (Lawsuit) Comment below for more information. We will not allow the state or local BOCES to rule over our districts. That is the role of the BOE.

It shows updates tp 124-2(d) and adds 124-8.
The added item -8 states that participation in the planning process is not mandatory and if schools opt to not participate they must reply in writing.
So now it appears they way I read it is school districts can opt out of the "planning", but no change in the language about participation in the regionalization implementation.
